Accident Benefits

A) Accident means any bodily injury resulting in permanent disablement (incapacitation) [Permanent partial disablement as defined in the Employees’ Compensation Act, 1923] or death directly from accident arising out of and in the course of his employment [or and on the regular route from home to his workplace and from the workplace to his home, the beneficiary met with an accident resulting in his death],

B) Eligibility Every registered construction worker, who met with an accident during the course of his employment [or on regular route from home to his workplace and from workplace to his home, the beneficiary met with an accident resulting in his death], is eligible for accident benefit

C) Claim:

  1. Every registered construction worker who is eligible for accident benefit under sub-rule (2) shall apply to the Board in the doctor of the Government hospital or of the recognized hospital who has treated the applicant showing clearly the percentage of permanent disablement (incapacitation) and permanent partial disablement suffered by the applicant due to the accident occurred to him and also his age at the time of accident];
  2. Provided that a construction worker, who is eligible for, accident under sub-rule(1) and (2) should produce to the Board, a certificate [in Form XXI-A] by his Employer in proof of accident occurred to him [or F I R or post-mortem report].
  3. The Board shall examine every application for accident benefit on accordance with the provisions and may accept or reject the claim. The decision of the Board shall be final
  4. Provided that the Board shall, before rejecting a claim for accident benefit give the applicant a reasonable opportunity of making the representation.

D) The Board shall grant an amount of 2,00,000/-(Rs. Two lakhs only) to the nominee/ dependent as the case may be of the deceased beneficiary and out of this Rs. Two lakhs amount, an amount of Rs, 1,50,000/-(Rs. One lakh fifty thousand only) shall be invested by the Board in the post office monthly income scheme in the name of the nominee / dependent in order to secure a monthly income to them and the balance of Rs. 50,000/- (Rs. Fifty thousand only) shall be invested by the Board in the post office monthly income scheme in the name of the nominee/ dependent of the deceased. In the case of Permanent total disablement (incapacitation), the Board shall grant an amount of Rs. 2,00,000/- (Rupees two lakhs only) or such proportionate percentage of the compensation of Rs 2,00,000/- in case of permanent partial disablement suffered by the applicant proportion to the percentage of disability mentioned in the medical certificate issued by the doctor of the Government Hospital or the recognized private hospital or recognized RSBY hospital.

E) Assistance to the dependents of the unregistered building worker.

In case of accident resulting in his death of a unregistered building worker or in case of accident resulting in grievous injury, due to the collapse of building under construction.
His dependents are eligible for an ex gratia amount of Rs. 50,000/- and in case of grievous injury caused to the building worker who is not a registered beneficiary under said Act is eligible for an ex gratia amount upto Rs. 20,000/-

  1. The dependent of the deceased unregistered building worker shall apply for the ex gratia amount under sub-rule (1) to the Board in Form XXI(A) and the form shall be accompanied by the survivorship certificate issued by the Thasildar, the original or attested (by gazette officer) copies of death certificate of the deceased unregistered building worker, his post-mortem report and First Information Report (F. I. R) and a report in Form XXI(B) issued by the Labour Officer of the area in whose jurisdiction the building or other construction work has collapsed and caused the death of the unregistered building worker.
  2. The grieviously injured unregistered building worker shall apply for the ex gratia amount under sub-rule (1) to the board in Form XXI(C) and the form shall be accompanied by the original or attested (by gazetted officer) copies of the medical certificate in Form XXI(D) issued by the Labour Officer of the area in whose jurisdiction the building or other construction work has collapsed and caused the death of the unregistered building worker.


Explanation:The labour Officer means the Officer of the Department of Labour, Government of Karnataka.

  1. As soon as the incident of collapse of a building or other construction work in his jurisdiction, comes to his knowledge, the Labour Officer shall visit the site of the incident and conduct such investigation of the incident as he deems fit and submit a report in Form XXI(B) and Form XXI(E), as the case may be to the Board and shall issue a copy of the said report to the dependence of the decease unregistered building worker and to the injured unregistered building worker as required under clause (a) and (b) of sub-rule (1).
  2. The Board shall examine every application for ex gratia benefit in accordance with the provisions and may accept or reject the claim and same shall be communicated to the applicant. The decision of the Board shall be final:
  3. Provided that, before rejecting a claim for ex gratia benefit the Board shall give the applicant a reasonable opportunity to make the representation.

F) “Amount of ex gratia benefit” The Board shall grant an amount of Rs. 50,000/- to the dependents of the deceased unregistered building worker and an amount of Rs. 10,000/- to the grievously injured unregistered building worker. Provided that the application is complete in all respects and the prescribed documents are enclosed. This does not bar the dependents of the deceased unregistered building worker or the grievously injured unregistered building worker from claiming compensation under any other statute.

Explanation: For the purpose of this rule a building worker who is not a registered beneficiary under the Act as defined clause (d) of sub-section (1) of Section 2 of the building and Other Construction Workers [Registration and Employment and Condition of Service) Act, 1996, shall be an unregistered building worker.
